SHIPPING POLICY

This Shipping Policy (โ€œPolicyโ€) governs the terms under which Advanced Resonance Kinetics SA, a company organized under the laws of Switzerland with registered offices at 15 rue du Jeu-de-lโ€™Arc, 1207 Geneva, Switzerland (โ€œARKโ€ or โ€œthe Companyโ€); a Swiss company processes, fulfils and delivers orders. It forms an integral part of the Terms and Conditions of Sale. By placing an order, the customer acknowledges and accepts the terms set out below.

1. Fulfilment Locations and Processing Times

Orders may be fulfilled either from the Companyโ€™s logistics centre in France (Marnaz) or from its facility in the United States (Texas). The choice of fulfilment location is made solely by the Company based on stock availability, destination and operational considerations. Customers may not request or impose a specific fulfilment centre.

Standard fulfilment requires approximately three (3) business days. Public holidays in France or the United States may extend this period. Fulfilment time refers solely to the internal processing of the order and does not include delivery timeframes.

The Company does not guarantee same-day fulfilment or expedited preparation.

2. Delivery Timeframes

Delivery times displayed at checkout are estimates only and are not contractually binding. They vary by destination, carrier performance, customs clearance processes and other external factors outside the Companyโ€™s control.

Typical estimates are as follows, without any guarantee:

  • Europe (via France): approximately two to four (2โ€“4) business days;
  • International shipments from France: approximately three to five (3โ€“5) business days, subject to customs processing which may introduce delays of up to ten (10) business days;
  • Domestic U.S. shipments: approximately three to five (3โ€“5) business days;
  • International shipments from the United States: approximately five to seven (5โ€“7) business days, subject to customs processing delays of up to ten (10) business days.

Actual delivery times may differ significantly from these estimates.

Carrier delays, customs inspections, transport disruptions, strikes, weather events and similar circumstances shall not constitute grounds for cancellation, refund or compensation.

3. Shipping Methods and Carrier Responsibility

Once an order has been transferred to the carrier, the carrier becomes solely responsible for the transport and handling of the parcel. The Company has no control over carrier operations and shall not be liable for loss, theft, misdelivery, delays, damage incurred in transit, or incorrect status updates recorded by the carrier.

A parcel shall be deemed delivered once the carrier marks it as delivered, irrespective of whether the customer personally received the parcel.

Any dispute concerning delivery must be addressed directly by the customer to the carrier.

4. Customs, Duties and Import Charges

For shipments destined outside Switzerland or the European Union, all customs duties, import taxes, brokerage fees and administrative charges are the sole responsibility of the customer. These charges may vary depending on the destination country and are typically collected either at checkout or upon arrival.

Such amounts are non-refundable, including in cases where:

  • the item is returned;
  • delivery is refused;
  • the customer fails to pay the required import charges;
  • the parcel is destroyed or returned due to customs non-compliance.

If the customer refuses delivery to avoid customs charges or fails to comply with import requirements, no refund will be issued.

5. Address Accuracy and Modifications

The customer bears full responsibility for providing an accurate and complete shipping address at checkout. The Company shall not be liable for misdelivery, delays or loss resulting from incorrect, incomplete or outdated address information supplied by the customer.

Once an order has entered fulfilment or has been dispatched, no modification of the shipping address is possible.

If the customer requests a change of destination requiring rerouting or re-export, any resulting carrier fees, customs duties or administrative charges shall be borne entirely by the customer and may be invoiced by the Company.

6. Failure to Receive or Collect the Parcel

If a parcel is returned to the Company due to the customer's failure to receive, collect or accept delivery, including refusal to pay customs charges, the Company may:

  • retain shipping fees already paid;
  • deduct return shipping costs, customs fees or administrative charges from any refund due;
  • refuse a refund entirely where the product cannot be returned to stock.

Repeated instances may result in termination of the customer account.

7. Risk Transfer

Risk of loss or damage to the goods transfers to the customer at the moment the carrier confirms acceptance of the parcel.
Notwithstanding the foregoing, the Company may, at its discretion, assist the customer in filing a claim with the carrier; such assistance does not constitute an assumption of liability.

8. Partial Shipments

The Company reserves the right to ship an order in multiple parcels if operational needs require it. This does not affect the fulfilment timeframe nor the estimated delivery windows communicated at checkout.

9. Force Majeure

The Company shall bear no liability for delays or failures in delivery where such delays result from events beyond its reasonable control, including but not limited to natural disasters, war, civil unrest, strikes, pandemics, customs backlogs, or carrier disruptions.

10. Amendments

The Company may amend this Policy at any time without prior notice. The version applicable to a given order is the version in force at the time the order is placed.

WARRANTY POLICY

This Warranty Policy forms an integral part of the Terms and Conditions of Sale and governs the conditions under which Advanced Resonance Kinetics SA, a company organized under the laws of Switzerland with registered offices at 15 rue du Jeu-de-lโ€™Arc, 1207 Geneva, Switzerland (โ€œARKโ€) or โ€œthe Companyโ€); a Swiss entity, provides warranty coverage for products purchased through its official sales channels. The present Policy supersedes any prior representation made verbally or in writing.

1. Scope of Warranty

The Company provides a limited warranty covering manufacturing defects affecting the physical components of the product. This warranty applies exclusively to the original purchaser and is not transferable.

The warranty does not cover defects or damage arising after delivery, nor does it apply to issues resulting from wear and tear, mishandling, or improper use as set out below.

2. Duration of Warranty

a) Manufactured Components
Manufacturing defects affecting the productโ€™s physical parts (excluding glass components) are covered for a period of six (6) months from the date of delivery, unless otherwise expressly stated at the time of purchase.

b) Glass Bottles
Glass bottles are inherently fragile. The Company therefore provides no warranty for breakage, cracks or damage occurring after delivery. Only breakage documented upon delivery and reported in accordance with Section 7 may be considered for replacement.

c) Crystals
Where applicable, the โ€œcharged effectโ€ of serialized ARK Crystals may be covered as a distinct, non-physical warranty. This coverage does not extend to any physical component or accessory surrounding the crystal.

3. Exclusions

The warranty shall not apply in any of the following situations:

  • breakage, chipping or cracking of glass components occurring after delivery;
  • damage resulting from drops, impacts, shocks or exposure to undue pressure or torque;
  • misuse, improper handling, negligence or failure to follow care instructions;
  • exposure to humidity, liquids or environmental conditions not suitable for the product;
  • loss, theft, cosmetic deterioration or normal wear and tear;
  • alterations, repairs or modifications performed by any party other than the Company.

The burden of establishing a manufacturing defect lies with the customer.

4. Shipping, Customs and Related Costs

The customer is responsible for the cost of shipping the item to the Companyโ€™s repair facility, together with any customs duties, import taxes or administrative charges incurred. Where the Company elects to repair or replace a defective item under warranty, the Company may, at its discretion, cover the cost of return shipment; however, inbound transport remains the customer's responsibility unless expressly stated otherwise.

If additional items or accessories are included in a parcel contrary to Company instructions, any supplementary charges arising from customs authorities may be billed to the customer.

5. Assessment and Determination

Prior to authorising any return, the Company may request photographs, videos or further information. Any preliminary assessment provided by customer support is indicative only and shall not constitute a binding determination.

A final warranty decision shall be made solely after physical inspection at the Companyโ€™s repair centre in France. Items sent without prior authorisation or without an assigned RMA number may be rejected or returned at the customerโ€™s expense.

6. Remedies

Where a manufacturing defect is confirmed within the applicable warranty period, the Company may, at its sole discretion:

  • repair the defective component; or
  • replace the defective component or product with an equivalent item.

The Company does not guarantee that replacement items will be identical in appearance, finish or material to the original product.

If no defect is found, or if the damage falls within the exclusions listed in Section 3, the customer shall be responsible for the return shipping costs and any customs or administrative fees associated with the evaluation.

7. Damage Upon Delivery

Any damage observed upon delivery must be reported to the Company within forty-eight (48) hours of receipt. Claims must include photographs of the product, packaging and shipping label.

Claims submitted beyond this period shall be deemed inadmissible, and the Company shall bear no responsibility for damage attributed to transport or handling after delivery.

8. Limitation of Liability

To the fullest extent permitted by Swiss law, the Companyโ€™s liability under this Warranty Policy shall be strictly limited to the repair or replacement of the defective product as set out herein. No other forms of compensation, whether direct or indirect, financial or consequential, shall be owed.

Under no circumstances shall the Company be liable for breakage of glass components occurring after delivery or for any damage arising from misuse, neglect or improper handling.

9. Procedure for Warranty Claims

To initiate a claim, the customer must contact the Company at support@arkcrystals.com and provide:

  • the subject line: โ€œWarranty Claimโ€;
  • the order number and purchase date;
  • a description of the issue together with supporting photographs.

The warranty period is deemed preserved if the customer submits a valid claim within the applicable timeframe, even if processing requires additional time due to internal workload, public holidays or other operational constraints.

Further procedural requirements, including the mandatory RMA process, are detailed in the Companyโ€™s Repair Policy.

10. Amendments

The Company may amend this Warranty Policy at any time. The version applicable to a given product is the version in force on the date of purchase.

TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (โ€œTermsโ€) set out the contractual framework governing all sales of products made by Advanced Resonance Kinetics SA, a company organized under the laws of Switzerland with registered offices at 15 rue du Jeu-de-lโ€™Arc, 1207 Geneva, Switzerland (โ€œARKโ€) or โ€œthe Companyโ€);

By placing an order through the Companyโ€™s website or any associated platform, the customer expressly agrees to be bound by these Terms without reservation.

1. Governing Law and Jurisdiction

These Terms and any dispute arising out of, or in connection with, the purchase of products shall be governed exclusively by Swiss substantive law. 3. Prices and Payment

Prices displayed on the website are stated in USD, EUR or any other currency as determined by region. Prices are exclusive of customs duties, import taxes, VAT, brokerage fees or any additional charges applied by carriers or financial institutions. The Company reserves the right to correct any error relating to pricing or stock availability at any moment prior to dispatch. Payment must be made in full at the time the order is placed.

4. Formation of the Contract

A contract of sale is formed only when the customer receives a written order confirmation from the Company. The Company may refuse an order where fraud is suspected, where the information provided by the customer is incomplete or inaccurate, or where the order appears abnormal in nature or quantity.

5. Modification or Cancellation of Orders

Once an order has entered the preparation phase, has been fulfilled, or has been transferred to a carrier, it may no longer be cancelled or modified by the customer. Delivery delays attributable to carriers, customs authorities or any external circumstances do not constitute a valid ground for cancellation, refund or compensation.

6. Shipping, Fulfilment and Delivery

Orders may be fulfilled either from the Companyโ€™s logistics centre in France or from its facilities in the United States, depending on operational considerations. Standard fulfilment requires approximately three business days; public holidays in France or the United States may extend this period.

Delivery timelines communicated during checkout are estimates only. The Company declines all responsibility for delays arising from carrier operations, customs inspections, weather conditions or any other circumstances outside its control. A parcel shall be deemed delivered once indicated as such by the carrier. The Company shall not be held liable for theft, loss or damage occurring after delivery has been confirmed.

7. Customs, Duties and Import Taxes

For all shipments destined outside Switzerland or the European Union, the customer is solely responsible for the payment of all customs duties, import taxes and related administrative charges, whether they are collected at checkout or upon arrival in the destination country. These amounts shall not be refunded by the Company under any circumstance, including in the event of a return, refusal of delivery or destruction of the parcel by customs authorities. If the customer fails to settle such import charges and the parcel is returned or abandoned, no refund shall be issued by the Company.

8. Inspection at Delivery

The customer must examine the delivered goods immediately upon receipt and notify the Company of any apparent defect, breakage, missing item or delivery error within forty-eight (48) hours. Any claim submitted after this period shall be deemed inadmissible, and the Company shall bear no liability for issues related to transport or handling after delivery.

9. Returns and Withdrawal

Returns are governed by the Companyโ€™s Return and Refund Policy, which forms an integral part of these Terms. Customers located in the United States do not benefit from an automatic statutory right of withdrawal. Returns shall only be accepted in accordance with the conditions expressly set out by the Company.

Products must be returned unused, unopened, and in a condition permitting resale. Goods sealed for hygiene or safety reasons (such as glass water bottles) cannot be returned if the protective seal has been broken or removed. All return shipping costs are borne exclusively by the customer. Customs duties, taxes and import charges already paid shall not be refunded. Items returned in a used, damaged or altered condition will be rejected.

10. Restocking Fees

For returns accepted by the Company but not arising from a verified manufacturing defect, the Company may apply a restocking fee, typically between fifteen percent (15%) and twenty-five percent (25%) of the value of the returned goods, to cover inspection, processing and administrative costs.

11. Warranty

Warranty claims are governed by the Companyโ€™s Warranty Policy. Manufacturing defects affecting physical components are generally covered for a period of six months, unless otherwise specified. Glass bottles are expressly excluded from warranty coverage in the event of breakage occurring after delivery, due to their inherently fragile nature.

Damage resulting from misuse, impact, exposure to water or humidity, improper handling or negligence is excluded from all warranty obligations. The Company may request supporting photographs or additional information prior to authorising a warranty return. Any preliminary indication by customer service shall not constitute a final decision; final assessment is made only after physical inspection of the returned product.

12. Limitation of Liability

To the fullest extent permitted under Swiss law, the Company shall not be liable for indirect, consequential or financial losses, nor for any damages caused by misuse, negligence, impact, exposure to water or humidity, wear and tear, or any circumstance beyond its control. Liability for any claim relating to a purchased product shall be limited strictly to the amount paid by the customer for said product.

13. Force Majeure

The Company shall not be held liable for any delay or failure in the performance of its obligations resulting from events beyond its reasonable control, including but not limited to natural disasters, wars, strikes, governmental restrictions, pandemics, transportation disruptions or any other event qualifying as force majeure under Swiss law.

14. Intellectual Property

All trademarks, images, text, designs and other content displayed on the Companyโ€™s website or materials remain the exclusive property of the Company. Any reproduction or use without prior written consent is strictly prohibited.

15. Personal Data

The processing of customer data is governed by the Companyโ€™s Privacy Policy, available on its website.

16. Amendments

The Company reserves the right to amend these Terms at any time. The version applicable to a given order is the version in force on the date the order is placed.

1. General Principles

The Company accepts returns strictly in accordance with the conditions set forth in this Policy. Customers located outside the European Union, including those residing in the United States, do not benefit from a statutory right of withdrawal; any return is subject solely to the Companyโ€™s contractual terms.

The Company reserves the right to refuse any return that does not comply with this Policy.

2. Return Eligibility and Conditions

The customer may request a return within fourteen (14) days of delivery, as evidenced by the carrierโ€™s tracking information. Any request submitted after this period shall be automatically rejected.

Returns shall only be accepted if all of the following conditions are met:

  1. The product must be unused, unworn and in perfect, resalable condition.
  2. The product must be returned in its original packaging, together with all components and accessories.
  3. A valid proof of purchase must accompany the return.
  4. The customer must obtain prior written authorisation from the Company before shipping the item.

Products returned in a used, damaged, incomplete or altered condition shall be rejected and may be returned to the customer at their own expense.

Sale items, discounted items or gift cards are non-refundable.

3. Exclusions

The following products and circumstances are excluded from the right to return:

  • Glass water bottles or similar hygiene-sensitive items;
  • products damaged after delivery, regardless of cause;
  • products exposed to improper handling, moisture, impact or abnormal conditions;
  • products purchased as final sale or explicitly stated as non-returnable.

Items that cannot legally or hygienically be inspected, restocked or resold will not be accepted under any circumstances.

4. Return Procedure

Before shipping any return, the customer must contact the Company at support@arkcrystals.com and include:

  • the subject line โ€œReturn Requestโ€;
  • the order number and date of purchase;
  • the reason for the return.

The Company will review the request and, if accepted, provide written instructions for the return.
Unauthorised returns or returns shipped contrary to instructions may be refused or subject to additional administrative charges.

The customer bears full responsibility for ensuring that the return parcel is properly packed, insured if necessary, and shipped using a traceable service. The Company does not guarantee receipt of returned items and assumes no responsibility for parcels lost, damaged or delayed during transport.

5. Shipping Costs, Customs Duties and Taxes

All costs associated with the return (including outbound and inbound shipping, customs duties, import taxes, carrier surcharges and administrative fees) are borne exclusively by the customer.

Amounts paid for customs duties, VAT or import taxes are never refundable, even in cases where the product is returned, refused on delivery or destroyed by customs authorities.

If the customer refuses to accept the parcel upon delivery, or fails to pay the necessary import charges, no refund shall be issued for the order.

6. Inspection and Refund Determination

Upon receipt of the returned item, the Company will conduct an inspection to verify compliance with this Policy. The customer will be informed by email whether the return has been approved or rejected.

If approved, the refund will be issued to the original method of payment within three to five (3โ€“5) business days, excluding any bank or processing delays outside the Company's control.

The Company may apply a restocking fee of fifteen percent (15%) to twenty-five percent (25%) for any authorised return not attributable to a verified defect or error on the Company's part. The restocking fee covers inspection, repackaging, hygiene disposal costs and administrative handling.

If the return is rejected, the customer may request that the item be shipped back at their own expense.

7. Damage or Loss During Return Shipment

The Company bears no responsibility for damage, loss, delay, seizure or destruction of returned items during shipment. Any damage affecting the condition of the returned goods may lead to partial or full refusal of the refund.

Customers returning items valued over USD 100 are strongly advised to use insured and trackable shipping services.

8. Exchanges

Exchanges are permitted only when a product is received in a defective or damaged condition upon delivery and reported within the required timeframe. Exchanges are processed in accordance with the procedures applicable to defective products and may require the item to be returned for inspection.

Exchanges are not provided for reasons of preference, size, colour or personal choice.

9. Misuse of the Return Policy

The Company reserves the right to refuse further returns, impose additional administrative fees, or close customer accounts in situations involving repeated abusive returns, fraudulent claims, misuse of policies, or behaviour inconsistent with normal consumer activity.
